3. Conclusion of Contract  

The presentation of goods in the online shop does not constitute a binding offer, but merely represents an invitation to order. By clicking the “Submit order” button you are placing a legally binding order in relation to the products in the shopping cart. The arrival of the order is immediately confirmed after it has been placed, however, this confirmation does not yet constitute our acceptance of your order. The sales contract is concluded when we accept your order by sending an order confirmation via email or by delivering the goods within 2-5 days.

We will save the wording of the contract and will send you the details of your order as well as our General Terms and Conditions by email. The details of your recent orders can be found in your customer account after login.

5. Right of Cancellation

Consumers have the right to cancel a contract within 30 days.


5.2 Cancellation Policy


Right of Cancellation


You have the right to cancel this contract within 30 days without giving any reason. The cancellation period will expire 30 days from the day on which you or any third party named by you who is not the carrier took possession of the goods. To exercise your right of withdrawal, you must inform us at the following address:

about your decision to cancel the contract by a clear statement (e.g. a letter sent by post, or an email). You may also use the  model cancellation form, but you do not have to. In order to meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.


Effects of Cancellation


If you cancel this contract within the cancellation period, we will reimburse to you all payments received from you, including the costs of delivery (except for supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us). We will make the reimbursement without undue delay and not later than 14 days after the day on which we were notified of your cancellation of the contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. We may withhold the reimbursement until we have received the goods back again or you have supplied evidence of having sent back the goods, whichever is the earliest. without undue delay and in any event not later than 30 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 30 days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning the goods.



6.3 Exclusion/Expiration of the Right of Cancellation


The right of cancellation does not apply to


• the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or stimulation by the customer is significant or goods that are clearly tailored to the personal requirements of the customer.


7. Prices and Shipping Costs  


7.1 Prices


Prices quoted on the internet are in Euro (EUR) and include the statutory value added tax. The Customer may choose between the following payment methods: Advance payment, credit card payment. Further information regarding payment methods can be found on our website.



7.2 Shipping Costs


4.1. The customer pays all shipping charges. Shipment prices are stated extra during the order process and appear on the bill separately. In case of shipping abroad the Customer may be charged additionally. Further custom duties, taxes and charges arise for shipments outside of the EU.

4.2. If the Customer shall be responsible for an undelivered shipment, they shall have to bear any additional costs. Shipments shall be considered undelivered if no eligible recipient of the goods is met upon delivery and the retrieval period has past, the receipt is rejected by either the intended recipient or an eligible person or the recipient cannot be found under the stated address.

4.3. Delivery times stated on our website or in our order confirmation refer to the time of our order confirmation, however, in case of advance payment only by the time we receive a credit note. Delivery times may differ abroad, depending on the shipping company.

4.4. Delay by act of nature beyond control (force majeure), strike, not correct and punctual supply to Booda Bike or other unforeseeable disturbances caused through no fault of ourselves make no demands by the customer to Booda Bike.

4.5 The goods shall remain the property of Booda Bike until the purchase price has been paid in full. Third party access to goods subject to retention of title shall be reported to us immediately by the Customer. The Customer is liable for all costs that may arise in the resolution of such seizures, especially by filing third party proceedings, as long as the disbursement of expenses cannot be obtained from the third party in question.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last lot or piece.

For shipments to countries outside the EU, the VAT included in our prices will be deducted upon invoicing. For deliveries to countries outside the European Community customs and taxes may be incurred in the importing country. For more detailed information on the customs and import regulations of your country, please contact the local Chambers of Commerce and Industry or customs offices.

FTA free trade agreement with the EU:

BOODA Bike is not an approved exporter and cannot specify any positive preference statement on the invoice. All countries of origin are marked on our invoice, which could affect imports (country of delivery) to non-EU countries. So please contact the local customs offices for more information on customs duties.

9. Payment Options  

We accept the following payment options:


Cash on Delivery:


You pay the amount due to the postman. Please note that you have to pay a charge of currently € 5,60 (cash on delivery fee) in case of payment by cash on delivery. A delivery by cash on delivery is only possible within Germany.


Credit Card:


We also accept payments with MasterCard or VISA. Please enter a valid credit card number, CVC code and expiration date when placing your order. Your credit card will be charged the invoiced amount at the time of dispatch.



Invoice:


Comfortably transfer the total amount after receipt of delivery.



Please give your IBAN number, the account holder’s name and the name of the bank when placing your order. Payments by Direct Debit can only be made within Hungary. Only private customers, no companies or institutions, are allowed to pay by Direct Debit. The direct debit will be taken approx. 14 days after delivery.


Prepayment:  


Please transfer the total amount of your order to the bank account stated below in advance and provide your customer or invoice number, the full name of the person who placed the order and their place of residence (please make sure to also include the shipping costs when paying in advance):

10. Reservation of Ownership  

The goods will remain our property until all payment obligations are met.  

11. Warranty and Guarantees  

11.1

Please check the delivered goods immediately for obvious defects in material or manufacture or transport damage. You ought to inform us of any defects or faults of the goods immediately so that we can take remedial action and help as fast as possible.

6.2. The right of warranty shall not subsist if the error was caused by misuse as in the following content: the object of purchase was used incorrectly (jumps, radical use, crashes); the object of purchase was changed into a configuration which is not permitted by Booda Bike; the customer did not follow the instructions of usage, operations and maintenance of the object of purchase. Natural wear is excluded from warranty.

11.2

11.2.1. Full liability: Booda Bike shall be liable for malice and wanton negligence. In case of ordinary or slight negligence, Booda Bike shall be liable only for breaches of a material contractual obligation, as well as for injury to life, body or health.

11.2.2. Limitation of liability: Booda Bike, in case of ordinary negligence, shall only be liable:

a) for damages that occurred due to the breach of an essential or cardinal contractual duty, which enables the proper and legal execution of the contract in the first place and on which the contractual partner relies and may as a rule rely on its compliance, however, these shall be

b) limited to the reimbursement of the foreseeable, typically occurring damages at the time of contract formation

This limitation of liability shall also apply in favour of Booda Bike’ vicarious agents.



12. Returns / Return Costs

Our packaging is also suitable for return shipments. A ready-made returns label is enclosed in all our parcels that are shipped to Germany, Switzerland and Liechtenstein. As soon as you have logged in to your customer account, you can request a returns label for your country by clicking on the category “Returns” (not for bikes, see section Transport Damages/Claims). Simply hand the parcel over to the post office with the returns label on it. Please also include the completed returns form. When requesting a return, the goods may also be picked up at your address if need be. Returns from EU Member States, Switzerland and Norway are only free of charge when using our returns label or when a pick-up has been arranged by us. When returning goods from other third countries, you will bear the direct costs of returning the goods as well as the return customs clearance.


The use of the returns procedure offered is not mandatory for effective exercise of your right of withdrawal.


13. Transport Damages/Claims  


Please inform us of any transport damages immediately. If the parcel looks as though it is damaged upon arrival, please open it while the delivery person/carrier waits and ask for a written confirmation of the damage. The failure to note damage or to open the parcel while the delivery person/carrier waits does not affect your statutory warranty rights.

Please always use our returns label to send back a parcel (except for bikes). Please wash used articles of clothing before returning them. Please pack helmets and shoes into their box as well as into the shipping carton before sending them back. Please note that the terms mentioned are not prerequisite to the effective exercise of the right to cancel or to the assertion of your warranty claims. Please contact our Bike Service for bike returns to coordinate the processing.

14. Applicable Law/Jurisdiction  

14.1


Place of performance and exclusive place of jurisdiction is Budapest. Hungarian law applies exclusively.


15. Links

As far as this website contains external links (hyperlinks) to websites operated by third parties, the respective operator is always responsible for the contents of the linked websites. Booda Bike checked the linked sites for possible violations of law at the time of linking. Nevertheless, Booda Bike has no influence on the contents of those sites so that Booda Bike takes no responsibility for the contents of the linked websites. Moreover, Booda Bike regularly controls the linked pages and shall immediately remove the respective link upon notification of any violation.

16. Other  

16.1

Indications of weight, geometries and features are information provided by the manufacturer. Technical changes for the purpose of technical progress as well as colour deviations, errors and typing errors are excepted. Delivery is conditional on the availability of stock.

16.2

Online dispute resolution according to Art. 14 Section 1 ODR-VO: The European Commission will set up an online platform for dispute resolution (OS) that can be found at https://ec.europa.eu/consumers/odr/.

Massive Corporation Kft. is willing to use alternative dispute resolutions of arbitration bodies.
